Governo Federal não cobra taxa ambiental de carros com mais de 20 anos

Constituição Federal determina a instituição de impostos sobre automotores como sendo de competência estadual

É falso que o Ministério da Fazenda esteja criando uma “taxa ambiental” para carros com mais de 20 anos de uso. São os Estados e o Distrito Federal que possuem competência para instituição de impostos sobre automotores, de acordo com o inciso III do artigo 155 da Constituição Federal.

Em alguns municípios brasileiros, notadamente em cidades turísticas, existe a Taxa de Preservação Ambiental (TPA), que muitas vezes é cobrada por veículo visitante. De competência municipal, a TPA é prevista no inciso II do Artigo 145 da Constituição Federal bem como nos artigos 77 e 78 do Código Tributário Nacional.

Atualmente, o Congresso Nacional debate uma Proposta de Emenda Constitucional que pretende isentar do Imposto sobre Propriedades de Veículos Automotores (IPVA) os carros com mais de 20 anos de uso. A PEC 72/23 já foi debatida no Senado Federal e está atualmente em discussão na Câmara dos Deputados.
